I was hoping someone might be familiar enough with sucession law to assist me with understanding a potential issue a family friend has. What possible resolution is there for an issue whereby a lump sum pension payment due to the estate will not be paid by a pension company as they are aware of adult children of the deceased. If say after 6 six year nobody can track them down, is the pension company within its rights to indefinately withhold the proceeds in the extremely unlikely event that the children appear (say they dont live in this country nor did they ever have contact with the deceased or any family members of the deceased). The pension company are only aware of existence as in an initial letter it was declared that children (now adults) did exist but never any contact.appreciate any comments. Thanks

    |If someone has not been heard of for 7 years there is a process where they can be deemed by the court to be presumed dead. Reasonable efforts have to be made to locate them.
