Broadband provider breach of contract?

    If I'm paying for 3mb wireless broadband and the broadband speeds that I received are substantially less than that, is the provider in breach in contract?

    First thing you should do is to check your contract. This is a common complaint and broadband providers will be aware of this. It's almost certain there will be a provision in the contract dealing with the speed provided and exempting the provider from proiding the exact speed all the time.

    it's usually a case of providing 'up to' 3mb. More than likely you'll get 3mb during off peak hours, in the wee hours, so they can say that they have provided 3mb and fulfill their contract. Next Generation Broadband is the way to go nowadays.

    You will almost certainly be paying for UP TO 3MB on your contract... ie 3MB will be your theoretical maximum connection, but there is no implication that it will always be 3MB

    No trees were harmed in the posting of this message, however a large number of electrons were terribly inconvenienced.

    Thanks for the replies. I'll have to check to terms of the contract, if my memory is correct I think the contract was agreed over the phone.
