Legal Advice for a Mortgage

    I got a letter from the company that gave me my mortgage a few months back, I just rooted it out again as it was on the back of my mind to do so.

    It is in relation to the wording of the letter and my insurance policy. this is what it says:
    We write in connection with the above mentioned matter, and confirm that it has come to our attention that your Life Policy has not been assigned to ***** Bank

    As this was a condition of your loan offer, we would be obliged if you would now arrange to have the attached letter of Assignment (pre populated with your policy details) signed and witnessed (by anyone over the age of 18), and returned directly to us. We enclose pre-paid envelope for your convenience.

    thank you for your assistance in this matter and we look look forward to hearing from you at your earliest convenience.




    May be a long shot. but I was wondering if the text in bold above would make the mortgage null and void. If there are any legal people out there that may have a clue about this I'd appreciate it. As if I had the chance to walk away from the mortgage I would.

    I can't give you any advice on the letter you received but you do realise that if your mortgage never existed you would be liable to pay back all the money you received plus interest.

    Are you suggesting that your failure to assign you life policy should result in you being permitted to keep the loan/mortgage monies and not have to pay it back?
