The course I am doing at the moment is a 2 year fetac level 6 childcare course. The first year is level 5. I'm thinking of leaving after my first year but will I still get my level 5 if I don't go back for the 2nd year?

Probably, provided you have completed all 8 modules. It would probably be a good idea to have a chat with the co-ordinator of the course just to make sure.

Any modules completed at Level 5 before you finish have to be put forward for assessment. Even if you only finish one module (for example Communications) it should be put forward to get a component certificate.
