    hi all, my friend was involved in a car accident where she broke her back. she is being done for careless driving and her solicitor is fighting it. what happens next? her solicitor is trying to prove contributory negligence. is that a seperate car and when will that be dealt with?

    If she has a solicitor why does she need you asking questions like this in a public forum? The solicitor can answer your questions, that's what he or she is paid for.

    Sounds like completely seperate cases. Careless driving is a criminal offence. Once criminal proceedings are complete the other driver can bring a civil suit for damages. In the civil suit your friends solicitor can claim contributory negligence on the part of the other driver in order to reduce the amount of damages.
