Legal age to apply for planning permission

    Hi guys and gals

    just a quick query

    How old do you have to be to apply for planning permission?

    Is it possible to apply for planning permission for a person under 18?
    for example if a mother and father want to bulid a house for their child, can they legally apply for it in the childs name?

    A loaded question.....:p

    If the site is in a rural setting, the applicant will most likely have to provide a genuine housing need. As a teenager is legally provided a roof over their head until they are 18 years of age with their parents, technically they have no housing need until after that time.

    If the site is in an urban or zoned area and the parents want to buy the site to build a house for their son/daughter for the future there is nothing to stop them from doing it.

    There is no legal age required although as Tom says if you have to prove housing need thats another issue. Councils differ on who can do what, I have an enforcement case where people who don't exist are making written complaints about a client and the council are responding to them even though they know the complainant dosn't actually exist, daft or what!!

    But, its takes maybe 2 years for the whole process.
    So a 16 year old could satisfy the need on the basis they wil be 18 once complete

    Or if you intended to construct a house over the 5 year duration of the planning you could argue you are applying for a 13 year old on the basis that they would be 18 when the house would be completed.

    Most LA's won't accept this, realistically there is a cut off point and it happens to be 18 years of age where an applicant can legally put their own case forward for themselves.

    Well a certain person writes a complaint to the Council and signs it as being from someone else who may have lived in the area a long time ago and the council treat it as a legimitate complaint, they have even sent out registered letter to the mysterous persons and had them all returned so they know they dont exist, Welcome to the twilight zone!!:eek:
