Sold my car, log book situation messy?

    Hi there,

    I sold my old car this evening and am happy, sold it to a youngish fella who gave me tha cash and now has it.

    He filled out the log book and I plan to send it to shannon on Monday, however he rang me an hour after the sale and said that he might have to change the name on the look to put his mother as the car owner so as he can get cheaper insurance :rolleyes:

    Now, it'd just be a case of changing the first name on the book to his mothers but can his own name(which he wrote down at the time) just be scribbled out or would a new book have to be sent away for?

    If this is a problem i'll just send the feckin thing on monday with his name on it and be done with it as technically, thats not my problem, the car is now his.

    Any light that can be shed? :)

    don't scribble it out, just draw a line through it and re-write the new name above it.

    it should be fine that way so long as your writing is clear, but even if it isin't, who cares as long as its out of your name :D

    Yeah Andy good idea actually. I just hope shannon wouldn't mind if the young fella's name was scratched out and his mams put above it.

    not at all, when i sold my micra a Polish couple bought it, the wife filled out the logbook, then they decided they wanted the husbands name on it, so they just drew a line through her name and wrote his.

    i posted the book later that evening. i have no idea how they got on, but the book never came back to me, so all is well :)

    I wouldn't be scribing anything or crossing.
    He wrote his name and signed under it.
    If you change the name, then it will be his mother's name with his signature.
    That can go as far as falsifying the documents.
    If he want's to do it, just ask him to come over and change it himself. Or the best if his mom comes over.

    Would it matter seeing as they are from the same family? Surely he could say he was buying the car "on behalf" of his mother hence his signature? If he forged his mothers signature that would be falsifying the document alright. I'd send it anyway.

    I'd just send it as is, if he wants it in his mother's name he can deal with that himself when he gets the log book.

    Ah the poor lad only wants to save a few euros,better in his pocket then a robbing insurance companies,it only takes 30 seconds too change the name and theres nothing illegal about doing it,its the name as just misspelling your name on it,just cross it out and write it in again.
    It would be the decent thing to do

    How do you know his mum agrees to it?
    Maybe she doesn't want a car in her name.
    It's not her signature there.
    And the field to fill in clearly states: Buyer signature.
    It can't be person on buyer behalf.

    Well I'd get his mam to sign it, I wouldn't let him forge it, so she'll know about it.

    It actually doesn't state "Buyer Signature", its states "New Owner Signature", he gave me the cash, he bought it but doesn't necessarily mean he's the owner of it if his mam goes down on the log book.

    If its registered in his mothers name and the insurance is taken out in her name and he is the only driver of the car (which is the assumption I am making about why he wants the details changed) then I can assure you there something very illegal about what he is doing if the insurance company ever find out.

    If you cannot afford to run the car properly and legally then you cannot afford to have the car

    I'd make the change and send it off. I'd take a photocopy of the changed document and get him to sign it so you have proof it was his request in case him mum turns out to be cool with it.

    I presume you didn't ask for ID or proof of address, so you've no way to know his name isn't Mrs Henrietta Smith, do you?

    As for the insurance issue etc. That's not something you have any responsibility for. Who's to say that, if he doesn't get cheap enough insurance he won't just drive without it.

    Your responsibility stops will transferring the ownership.

    Just as a side note, if he has it registered in his mother's name, and insured in her name, but he's the main driver, then its my understanding that it constitutes insurance fraud. No impact on the OP (unless he crashes into him or his family) but morally wrong.

    I recently sold my previous car and the buyer wanted me to put a certain date on the reg doc so that he could drive it under his own insurance 3rd party. I refused and instead offered to drive it to his house for him. It was his problem after that.

    Corrections on official documents should be done by crossing out with a pen, not with Tipp-Ex.
