on temp redundancy,boss wont pay wages,redundancy,or answer calls

    hello everyone,
    Ive been working for a small building company over 3 years now, myself and another employee have been put on temporary lay off since the start of february. the boss still owes us 3 days pay from the last week we worked and some holidays carried over from last year.

    Its now over 1 month later and he wont answer any calls or messages regarding wages or us coming back to work,and has other employees doing the work now that we were trained to do.

    an ex employee has also told us the boss hadnt been paying his pension all along and has since then sued him over it. and we're sure he hasnt paid ours either as its nowhere on any payslips. we're out of touch with the ex employer now though.
    can anybody shed some light on our options regarding unpaid wages, redundancy and sueing for unpaid pension payments?

    Temp lay off = no redundancy. It's sometimes used as a way to make people quit, so that the company doesn't have to pay redundancy. Is there a timetable of when you're going back to work, or is it open-ended?

    you can make your claim for redundacy as soon as you have been on lay-off for 4 weeks

    using an RP9 form. if your boss can offer you 6 weeks work in a 13 week period then you have to accept the work, but if he does not have any work for you he must pay the redundacy. if you do not receive any response to your RP9 within say 7 working days or if he just refuses to pay you or offer you work, then you must complete an RP77 (all these forms can be Googled and printed off).with the RP77 you are asking your boss formally to pay you your redundacy. send this to him by registered post, keep proof of posting and a photocopy of the completed form for your own records. it might become vital. if he does not respond to the RP77 within 10 working days, you will then be completing a T1A form and sending it to the EAT. this is you making a formal complaint to the employment appeals tribunal that your boss failed in his duty to pay you your redundacy. ring NERA 1890808090 (ignore prompts to press 1 2 etc, stay on the line till you speak to someone) regarding the holidays, 3 days pay etc. good luck
