Motor taxation Issue

I might be posting this thread in the wrong forum but I can't find a more appropriate one. fell free to move if necessary.

I was looking on some advice to do with taxing a car.

I am going to take a car my brother isn't using. Tax has run out and NCT has run out.

I will apply for NCT now straight away so that should be fine. I'm going to go to where he lives (30 mins away) and get car tomorrow. I will insure car, bring insurance details, logbook (signed over to me) and form tax office gave me and bring all this into tax office. they advised they will then send off logbook etc.
Person in tax office advised me that I would then be ok to drive the car until I get log book back and car taxed etc.

Is this true? I have been told by almost anyone else I spoke to that I would have to have tax for the car or will get done for it if I am pulled over.

So will I have to wait all that time for log book to come back, then tax car and only then be legally allowed to drive it?

I'm trying to do the right thing and also avoid picking up points on my first car.

Thanks for any help in advance.

Technically yes the legal requirement is to display a valid motor tax disc on the vehicle at all times while in a public place.

If you are stopped by a Garda, 99% of them will be happy if you show them a photocopy of the form you filled out and tell them that you have just bought the car. However, if you park the vehicle in a public place or you get a member of the traffic corps who's a stickler for the law, then you could find yourself fined for non-display.

They might even raise an eyebrow if you say, "I just got the car off my brother and I'm transferring it into my name". You'd be better off claiming to have just bought the car.

If you can wait, it would be safest to hold off until you've received the new Vehicle Registration Cert with your name on it. Then at least you can pay for the tax and show a receipt to any enquiring Garda.

But you will technically be in breach of the law until you have that tax disc.

That's great. Thanks very much for the detailed response! :)

    I just realised something.

I can just get Gardai to sign it as being off the road under my brothers name, tax it under his name and then send off logbook and I'll have my tax disc sorted and won't have to be waiting on the logbook. Job done.

    Thanks.
