Spearfishing laws.

    Hi all,

    You would think that having an LLB I would be able to find the info but for the life of me I cant track it down

    A friend was asking me what the exact position is on spearfishing in this country along with taking the likes of scallops and other fish.

    It seems to be a grey area according to him!

    EDIT: Just to note that this is in relation to spearfishing in the sea as opposed to in freshwater.

    from what I know there is no law against it as long as there is no explosive charge involved i.e. to fire the spear

    I tried looking into this a few years ago, and as you said it does seem to be a very grey area.
    as far as I can tell spring loaded e.g. elastic band etc, its perfectly fine.

    the only thing that would be a concern is spear fishing for bass as there is a size limit on the fish that can be retained... how would one measure a fish before spearing it?

    The same way fishermen do it, dump it if it's not allowed

    pneumatic guns are classified as firearms but springers are ok. picking shellfish is technically illegal due to a poorly worded law as I understand it

    yeah from what I've picked up on the net, a spring loaded gun is fine but the pneumatic ones are classed as firearms.

    And as far as Bass, I think there is a limit of 2 in any 24hrs. There is a size limit on scallops too.

    What I'm really looking for is the actual legslation or bye-laws on it. The fisheries act didnt seem to contain much! I dont know where else to look?
