Builder

    We are having an issue with a builder.

    We were recommended him by a neighbour do do some renovation work on our house. There was no contract signed so I think I am in trouble here.

    Anyway he did the work based on a forecasted time of 6 months. 8 months later and he was no where near finished so we got rid of him. He presented us with a bill for approx 65000 of which we paid 33000. I got a quantity surveyor to assess and he had a figure of 40,000 would cover us for the work done. Also there are some snags with the work for example our front door is just 6feet high (I am 6 foot 3), none of the internal walls reached the ceiling (they were all about 6 inches below it) and several other things.

    It was may 09 that we got rid of him and now he is looking for money. Where do I stand?

    You need to speak to your solicitor here. As well as the QS's report I'm sure the solicitor will need a report on the extent, condition and quality of works undertaken. They will then usually match both reports and proceed from there.

    Not having a contract is a big drawback when you're dealing with times and stage payments, but, not having a contract does not mean the works can slip in quality or standard of finish.
