Wayleave for Pipe

    Hi,
    I’m hoping for a bit of advice with the following issue.
    Myself and my wife own a site which is at the bottom of a cul de sac road in a residential housing estate. We recently applied for planning permission but got a call from the council a week ago requesting a meeting.
    It turns out that the council have plans to run a foul water pipe through part of the site – mainly the back garden. Luckily it doesn’t appear to affect the proposed building outline but there would be a manhole and length of pipe running through the back garden.
    At the meeting the council mentioned that they paid compensation for wayleaves of about 65euro per lin m and around 650euro for a manhole.
    I did some research on the web when I got home and there seemed to be some suggestion that compensation was paid for the loss in value of the site as opposed to a flat rate per lin m.

    If anyone else has any experience of this or advice I’d be grateful.

    It does mean if you sign it that the council or their agents can go on to your back garden anytime they like and dig the pipe up or do any work they need too, there is usually a 7m strip on either side of the pipe that will have to be kept clear. If you site is big enough to take it and you will not be extending in the direction of the pipe ever then it should be fine, if not you could ask if they could relocate the pipe outsite your site but they could of course also refuse planning, I don't know about the compensation I am involved in group water schemes and we have to get wayleaves regurarly but we normally avoid back gardens if at all possible and we dont pay any compensation!!
