sick/going back to work/possible robbery?

    I'm at the moment out sick from my job, if the job let me go from my position which I have a feeling they might. (are they allowed to if I hand in sick certs?) i've been out for about 5 weeks and don't see any return in the next month anyway..... (only got my first cheque this week!!) The job dont' seem too happy about it and I have been told by one of my collegues that I have been replaced by another worker and that when I come back I will be moved to a shop that is well known for being robbed(at least monthly in the last year), (I have been out to try to get my blood pressure down as it's stroke/heart attack high/ need to try to keep stress levels low).

    If I was to leave if they sent me to such a shop when i do go back to work (I don't think I could cope with worrying that someone was coming in with a gun) would i be entitled to anything?

    You should discuss it with your doctor. Potentially the doctor write a letter saying you can't be put in high strees situations.

    You might be entitled to illness benefit in such a case.

    There are all sorts of issues here in relation to employment law. There could be disability discrimination issues, unlawful changes to your terms and conditions etc.

    If you're a member of a union you should get in touch with them to advise in detail, alternatively call down to your local citizens information centre, congress trade union centre or free legal aid clinic for detailed advice and perhaps for them to write to your employer on your behalf.

    They would be the best place to get actual information on your situation.

    However, the reality is that your employer is not required to hold your job forever. What I can't understand is why you haven't discussed this with your employer. Hiding from them is going to make it look (from their perception) that you are unable to work. They have a business to run, not a charity.

    Also, I really doubt the shop gets robbed every week - shoplifting perhaps but robbed every week for a year - 52 holdups?

    OKAY first let me say I hope you get better/over this health issue, I wouldn't wish that on anyone

    BUT

    If you owned a business and someone was not there to perform the work they were employed to do, would you feel it's fair to ahve to pay them OR keep the job open?

    They can let you go when you are out sick - one of the key terms of a job is the ability to do it, which involves being there.

    You say they don't seem to hapy about it - are you serious?

    They can either move you to other shops are they can't - see your contract.

    If you leave why the hell would you be entitled to anything?

    Seriously hope you get better but you gotta inject some reality into this - what happens if everyone went out sick
