    I hope this is in the correct forum.

    My fiancee works "full time" in a restaurant and does anywhere between 20 to 35 hours per week, usually spread over five days and sometimes four on the occasional week.

    My question is this. Is there anyway ways or means that she can claim welfare benefit on the weeks that she works low hours. As far as I can see she can only claim for something if the hours were spread over three days. It seems very unfair.

    Any input would be greatly appreciated. Thanks.

    I'm not sure, but there's a chance she might qualify for SWA. She'd need to contact her local Health Centre to see if she does.

    barry could she not ask the boss to spread her hours over 3 days for example?she cannot get JB/JA for a day on which she works as she could not be considered as "looking for full-time work" on that day if she has to go to a job. however if the hours were late in the evening, and considering that there are relatvely few hours, there is a possibility that a Deciding Officer would consider that she was in actual fact available for work during normal working hours. incidentally in order to qualify for SWA you need to at least have a Sw payment pending so please dont bother wasting your time queuing to see the CWO. bottom line is, if her boss cant spread the hours over 3 days, maybe he could just give her the evening shifts and then she could make the case to the Deciding officer that she was available for work during the day. its not garuanteed though. best of luck. ;);)

    In order for some one to apply for a casual claim you have to be working for less that 4 days per week. Unfortunately it does not depend on hours per day.

    Working at night is not excluded unfortunately.
