Mercedes E200 (2003) Problem

Wondering if anyone can help me with some advice. Bought a Mercedes E200 in July 2008, 3 months warranty etc. After about two weeks I had to bring it back due to a jerking motion when accelerating and at crusing spped. I was told it was the torque converter.

So, the garage (Mercedes/Audi/Volkwagen dealer) sorted it for me. There was 60,000 km on the clock at that stage.

Fast forward to April 2009, same problem occurs and again I bring it back to the dealer and again am told it's the torque converter. To replace this (got a cost from another dealer service dept.) would cost anywhere between 4 and 5k. Luckily though, because the part was originally placed under warranty (or Mercedes warranty) I got it sorted free of charge. There was 73,000 km on the clock.

Which brings me to now, same problem, 21 months and 30,000 km later and I again have to bring it back to the garage. Will Mercedes or the dealer be liable to pay this? Can anyone point me to a link that would explain Mercedes rules on this? Surely Mercedes dont make this part with a view to having to change it AT ALL during the life of the car...I just dont see why I would have to pay for it , and want to have my arguments in order so the dealer doesnt try to bullsh*t me. Thanks!!!
