poor tarmac job

Hi folks. I got a contractor to do a tarmac job on my house last year. He tarmaced the driveway around my house. The quote was 8k. My wife and i were not happy about 3 cold joints left on the drive,2 at the front of the house and 1 at the back. I approached him on the day about the one at the back and he said that there would be no more. The reason for this was that he didn't have the tar lorries at the house on time. This was the reason for the 2 joints at the front also. The tar was also over rolled and this made the tar look about 10 yrs old as the roller took the tar off the chippings and left it grey looking. The stone used was limestone. We told him we were not happy and he said it was a good job and wanted his money. I got an independent enginneer to look at the job and he said apart from the joints which should not be there and the discolouration, the levels of the tar were way off also which means the water does not run off to gullys and it just pools on the surface in 3 or 4 different area's. To cut a long story short he sent me a solicitors letter and its now going to court. I have a full engineers report but he has nothing to present in court other than himself. My brief says i have a good case. He has offered to take 5k without predjudice but i want the whole lot removed and redone by someone else. Any advice????

I think the OP has already done that.

OP: there is no advice here that would imo supersede that given to you already by your brief.

Agree, listen to your brief and persevere
