housemate from hell

    Can anyone help me im living in a house with my girlfriend and 4 other housmates. One of them is a stoner who hasnt paid rent in last four weeks steal food and drink off me and broke my deep fat fryer when my girlfriend asked him if he was going to replace it he said **** off to her so if i was there i would have decked him. Today after i came home after two days i found my food and drink missing and the living room smells disgusting of ciggarttes. its a no smoking house.iv texted him telling him to replace it as he will not awnser his room door.He is trying to get on the dole and hasnt paid rent in 4 weeks. the landlord has allowed him to stay as long as he pays the esb bill he owes and can settle the rest after wen he goes on the dole in a few weeks. The land lord has also said he pays an extra 20euro rent which is bull as he only pays 40 for a box room so even the landlord is in the wrong..

    short of decking him what are my rights and how can i get him evicted as i cant afford to move out myself yet. Should i contact the police

    Your best option would be to move out. You're only going to bring a load of hassle on yourself if you try and take him on. Its a renters market now so moving could be the best option.

    I am assuming from above that this guy is dealing directly with the landlord in terms of rent.

    I would call the landlord again, tell him that he is ignoring the no-smoking rule which is stinking the place up, and you either want him to resolve the issue or agree in writing that none of the other tenants are responsible for any damage caused by this gobs***e.

    It is unreasonable for a landlord to withhold deposits from all tenants for damages caused by one, especially when the landlord is fully aware of the situation.

    What type of lease did you sign and when is it up? Did you each sign a lease with the LL or are you all named on one lease? There is no point contacting the police, they will view it as a civil matter.

    Did you and your housemates decide it was none smoking or is it written in your lease that it's non smoking? If you have it in writing go the LL and tell him that you wanted a non smoking house, your lease says non smoking so either the other housemate goes or you have the right to break your lease, get your deposit back and move out.

    so after i rang landlord and told her whats going on she has given him till next saturday to pay the 160 or 200 euro rent he owes if he doesnt do that and replace my stuff he is out. He getting 100euro on dole from wed on i moving out after i come back from new york just save money and cut my losses its ruined the last few days here so people avoid lurgan park if you are thinking of renting in galway thanks for all yer help:)
