    A landlord has a multi-story premises, flats on top and a shop below. If a pipe burst on the top floor destroying the contents of the shop below. Is its the landlords insurance that must pay or is it the shop owners own insurance policy that pays?

    I thought (open to correction) the shop owner would claim on their insurance, and the shop owner's insurance company would take steps to recover the money claimed from the landlord or the landlord's insurance?

    The shop owner must claim under his own insurance unless he can prove negligence against his landlord. A landlord cannot assume responsibility for his tenants contents under his own policy
