    Just wondered who upholds or polices eu directives such as - Copyright directive 2001/29, or is it a law with no policeman for small time offenders.

    It's a civil matter. No need for police involvement.

    You could simply bring a civil case to court.

    So hypothetically/ specifically speaking, if i was/am a musician or film producer - and if 25% of every internet service providers customers in the EU (eircom/vodaphone etc) downloaded my movies or albums for free. What then? the artist cant sue every individual in tort?

    Directives will be transposed into national legislation (generally) and will often provide both civil and criminal sanctions

    I'm having problems with a website that is constantly pirating my images and film clips and passing them on as their own. Cease and Desist Orders simply do not work for this particular website. Any advise is appreciated

    Ive tried locating host but they are so well hidden its impossible to find the true hosting company for this site.

    Is it an Irish based site and is there any reason why they would be using your material in particular?

    Perhaps you should look at watermarking your material? Lot of photo sites do this.

    You can go after the host once certain criteria are met. See SI 68 of 2003, Regulation 18 (Hosting) - This gives life to the eCommerce Direction 2000/31/EC - Art 14 is the relevant one.

    Mere conduit under Regulation 16 might also be of interest if targeting ISPs, or not as the case may be.
