Ok guys i crashed my car 2 weeks ago. The car has been in a garage waiting on the assessor to look at it. The assessor arrived on wednesday to look at it. The mechanic has now fixed my car and given it back to me. Am i insured to drive it now without anything been sorted out with my insurers. As far as they know the car is still in the garage. I havent sent off my claim yet as im awaiting a new logbook in the post. I never cancelled my insurance when i crashed so i assume im free to drive it?

The obvious answer is to ring the insurers and dont be taking advice on this off the internet. It wouldnt be a bad idea to tell them its on the road again anyway even if you never changed over cover to another car

Cheers for that. The problem is they think the car is still in the garage while they decide whether to pay out for the repairs or write the car off as the car is 8 years old and i done bout €2500 worth of damage to it.

I am a bit puzzled as to why the OP is waiting for a new log book to sort the claim..

Don't see why not if you haven't changed the insurance onto another car. No reason why the insurance would have lapsed just because the car was in a garage for 2 weeks.

The insurers want a copy of my logbook when sending the claim form in. I couldnt find my logbook and im now waiting 10 days since i posted off for a new one.

I never changed the insurance on to another car. Is it fraud to be driving the car while my insurance company think its in the garage awaiting repair?

Did you pay for the repairs out of your own pocket or something?

No the garage fixed it up and then i pay up when my claim comes thru. He's a local mechanic so i guess he trusts me. Is that the norm that they fix it up and then wait for payment once my claim has been processed? Nevr crashed before so havent a clue.

but you just said they have to decide weather the insurance will pay out or not......

why did you get it fixed without knowing if you could afford to fix it??
then your up sh1t creek no?

i dont think im up **** creek. The mechanic told the assessor that i didnt want the car wrote off so he repaired it then. my dilema is can i now drive the car while my insurer thinks the car is still in the garage?

Did the insurance give the go ahead to get the car repaired. Shur the insurance company might decide to write it off.

man i fully understand, but im just sayin,
i was in some what the same situation and the mechanic fixing the car has no say in weather its a write off or not, its up to the assessor or insurance company...so it still may be a write off in there eyes.

    but yes, you are insured.

no they never gave the go ahead so i guess the mechanic is at fault for fixing it then?

sorry i didnt mean to come across as an ass there. my view is that the car is insured so i can drive it. its confusing but having no car is doing my head in so i think i'll take the chance and just drive it for the time being

No you are. The mechanic hardly fixed someones car on his own accord. If they tell you the car is a write off your in trouble boss..

    as above, you are insured,

but if they come back an say its a write off, as corkie said  trouble...

well i told him i didnt want the car scrapped but if the insurer was going to scrap it why would he fix it. he had the parts got before the assesor came out so i think he's in the wrong. In fairness to him he wanted my car back to me asap and he's adamant that the assesor wont scrap the car

Its not up to the mechanic its the assesor who makes the final call.

I know it is. I think the mechanic should have waited myself but he's 40 years experience so i trust his judgment.

Would you drive the car now?

It depends on what type of write off the car is. There are economic write offs and I can't remember the other type but these are usually seriously damaged. From the OPs posts it sounds like it'll be an economic write off which is perfectly fine to put back onto the road.

When the claim is settled the insurance company will pay out for the book price for the car less it's salvage value. You are perfectly entitled to get the car fixed and back on the road if you want.

OP as has been said before. The only way you'll really know if you're insured is to call your insurance company.

I crashed my car last week, was towed into the garage the following morning, and the assessor was WAITING as the car was pulled into the garage (Tuesday). By Tuesday afternoon they had told me they were paying for the car.

I was like "jeez how efficent!".

Anyways, you should ring the insurance company and ask if they are going to repair it. Keep stum until you hear otherwise, but as others say, I dunno what to advise you if they decide its a right-off. 8 year old car at 2,500. If it is a right off, as someone said, it would be an economical one. I hope it works out for you...its a kinda scary process IMO.

So if they say its an economic write off and pay me say 2k i can then pay the mechanic for the work he's done and put the car back on the road?

They had made a decision before you even filled in a claim form? Mine was assessed last tuesday and still no word. The fact that i havent returned the claim form is what i think is holding it up  Its a stressful process more than a scary one imo

    It is indeed very stressful.

I have the form filled up since this evening, and will post it in the morning. The assessor said they would post it out to me (last Tuesday), but it never came, so I got it off insurance's website.

The assessor was in the garage waiting for the car to arrive in - I kid you not. He was there waiting for it. He looked at the damage the same time the mechanic did. He told mechanic to make up list, and to fax it to him. Which they did. I then got a call from the garage saying that they had faxed it to assessor and had heard back to proceed. They then ordered parts that day.

Happened quite fast. Then again, I hit a ditch on my own (go me :o), noone else in car/no other car involved/injuries etc, so nothing to hold it up.

Now, the garage say they will have it ready on wednesday, and Id say they will, but will they release the car? I dunno. I was told by one person id have to wait 7-10 days for insurance to pay garage - another person told me it would be ready to collect wednesday.

    Ring tomorrow and find out.

No, if its a write off then they pay out on the claim and take possession of the car. You can offer to buy the car back from them if you wish.

It depends, some insurance companies will send you a cheque for agreed book value less excess and salvage value. Others send you a cheque for agreed book value less excess and keep the wreck.

Hitman79 you'll have to call you're insurance company and find out what their procedure is and tell them you want to keep the wreck if they don't offer it.
