Casual Work Claiming Redundancy

    Hi i am hoping someone on here may be able to help me out..
    im 26, a qualified electrician,living with parents and currently on casual work slips at the social welfare office.. i have been on casual work since november 09..for the first few months work was not to bad a couple of days here and there but now it has completely dryed up(4 days) the last 3 months and no sign of improvement..
    It is only me and my boss left in the company..the rest of the lads have left over the course of the year..
    quite honestly im feed up being stuck waiting for him to call about work i know he is doing a good bit himself, i have rising debts i need to clear and i feel its time to move on..
    i am entitled to redundancy(9 years unbroken Service) however the social welfare wont give me a straight answer on the following:

    1)IF i claim redundancy from him,am i entitled to SW payment??the girl on phone in welfare office said possibly not

    2) IF i convince him to make me redundant am i entitled to a payment??

    3)would i be means tested my dad has a pretty good job and my mam does a few hours a week part time however we dont have the best relationship and they wouldnt really help me out..

    thanks for reading and any advice would be welcome

    If you have been working as a PAYE worker for thelast 9 years, you had about a year of Job seekers benefit to claim. This may be due to run out.This means one week when you have in your slips, you may not get paid and when you contact the office they will say you need to be means tested. I think they may cut you because of your family, though being 26 the cut may not be too deep.

    I think you are entitled to redundancy. It may be complicated. I'd advise you go the citzens information office. Bring as much info as possible with you and write down every thing they say to you.

    Do not just quit, I know someone in the same situation that did just that and it was only 3 months after he left that the only other employee left in the company got redundancy.

    At anytime were you classed as a sub contracter / self employed, if so things are a bit different.

    If the guy doesn't have the money to pay you redundancy you can claim it from NERA, but it can take months.

    Officially you have to be made redundant to automatically qualify (voluntary redundancies don't qualify) although this isn't usually specified on your redundancy form or the RP50 tax form the employer fills out. This is aside from the specifics wmpdd3 mentioned, so qualifying won't necessarily mean much.

    It's not redundancy if you're handing in your notice - he'll need to pay if you're to leave (he pays 60% of the statutory payment), so presumably he's not going to do that just because you ask him.

    Redundancy payments aren't means tested. Citizens advice will be better able to advise you, but I wouldn't have thought your parents' wealth would impact your application for jobseekers, if they're not supporting you. Can't see how it would be fair if it did, but I've no idea.

    Thanks for the help..
    so i got sorted.. talked to my boss asked him to make me redundant as it was pointless going on like this,i wanted to make a fresh start..he said no(heated argument ensued). so i told him im requesting my redundancy via my rp9 form.. after it was pointed out to me that he wouldnt make me redundant as he would have to pay me notice to..
    i have 15 weeks of 'stamps' left according to the welfare office so ive to bring my p45 in when i get it..
    after the 15 weeks..who knows.. il have to cross that bridge when i come to it.. hopefully il have some sort of work

    So he won't make you redundant but he wont give you work? I would call Nera just to make sure this right.

    If that was the case, no-one would get it, employers would just reduce their employees hours till they just gave up and left.
