Personal Injury Query

    Hi there,

    I have a High Court date next year with regard to a personal injury case. My last meeting with solicitor we discussed loss of earnings.

    I have been out of work due to injuries for 2 years and in the meantime the company went bust and i was made redundant. My solicitor told me that any award in relation to loss of earnings will have the redundancy total subtracted from it. I questioned this as it didnt sound right but he was pretty adamant that this was fact.

    Is this right?

    *my understanding is that ...if you are out of work the monies you have lost will be taken into account - unfortunately you will also have to point out to the court that at present you are unable to get back to work.

    *the fact you were made redundant should not affect your payout - it will/should be taken into account by the judge but he/she will also have to take into account that you are not in a position to find a replacement job..... future loss of earnings.

    The general principle is that the court award should put a claimant in the same position they would have been in had the injury not occurred. Since legal advice cannot be given, all I can say is go figure!
