Separation agreement/consent order

    Hi all,
    Just sitting down to sort out the forms to transfer for the mortgage into my name and just notice this portion of the request:

    "Separation agreement/consent order confirming maintenance & buyout & source of funds"

    I know I should called the bank to find out what this was but there closed until Monday.

    A signed letter (by both parties) was sent to the bank requesting the transfer into my name. When I first read this line I thought it was just if there was going to be a buy out but now I m not sure what the hell it is?:confused:

    She wants money for furniture in the house so I'm not mentioning that to them as it has nothing to do the house and I don't want to hurt my chances of getting the transfer.

    Nothing to do with your original query but are you in negative equity? If so is she paying her share of this? If not, tell her you're keeping the furniture in lieu of her portion of the negative equity.

    The bank says 20k. No she is not paying her share. Trust me I know this. I have had a solicitors and ea literally laugh down the phone that she would expect anything to be getting a way out of the mortgage but she's not going anywhere until she gets something and all the while I'm paying the mortgage for a house that she has ever legal right to be in, with who ever she wants :mad:

    So for the sake of hopefully a max of €3000 I m willing to sacifice my pride and logic and financial holdings to be rid of her.

    I'll sent this over to Legal Discussion. They can't give you advice, but they can explain things and give some pointers.

    What I suspect the bank is saying is they want to know that one person can afford to pay the mortgage to its natural conclusion and that there won't be any complications due to the separation agreement, e.g. if the separation agreement means you have to pay X per month and you earn Y and the mortgage is Z, will there be enough money left over for you to live on.
