who owns the work diary?

    Hi,

    I am being late go from work due to the recession, I have to return my phone, laptop etc. but they also want my work diary. Do I have to return my diary, is it not mine?

    I assumed it was my book, all client details are saved on a harddrive so they have access to all that info. Can I legally not give them the diary?

    It's a work diary not a personal notepad. I think that anything that you write on work stationary that is related to your work is the property of the business. You can have access to confidential information and they will not want employees leaving with documents that could contain confidential information.

    Who paid for the diary?

    Assuming it's the employer here.

    Also, assuming it's work related information in it, possibly sensitive information then they are 100% within their rights to ask for it, nay demand it back.

    Why do you want it anyway?

    If work paid for it they own it, if you put personal info into the work diary then foolish you

    doesnt matter if they paid for it really. If the information on it is confidential information owned byt he company its a perfectly resonable request to have this information in their hands and not in the public domain.

    If you were using a diary for work you should have just got them to get it for you

    the diaries were handed out to all employees,

    in my contract it lists what I have to give back, says nothing about the diary.

    I don't want or need to keep it but no other employer has ever asked for it back before,

    whats the value of holding on to it.?

    if you were in the construction industry and it was a site diary you would need to hand it back in as it holds daily information that will be needed to close contracts.

    copy what you need from it. censor your private info with a black marker and give it in.

    What if I had bought the diary myself, could they claim it?

    If your employer gave you your work diary, they own it.

    If you bought your work diary and used it for the purposes of work, they own the contents of the diary.

    Not sure what the big deal is really!

    Out of curiosity Why would they or you want the work diary?

    If you kept your diary on your own electronic equipment, phone, laptop, pda, online calendar. What then?

    Also what happens if you don't have a work diary, just one personal diary which has work and personal stuff in it.

    depends on the business.

    in construction you need to keep a daily diary. it would be foolish to have it anywhere else other than a seperate diary or file.

    I'm not bitter about being let go, I did my best but its tough at the mo. I gave it back last week, i didn't need it anyway but they gave me alot in regards training etc. If only I had job to put those skills to use!!
