What happen if you leave your job with a sorter notice?

    Hi,

    In my contract specify that I have to give my employer 3 months notice. I'm a software developer, the only one full time in this software company, the other is one of my bosses, and he's just partial time on development.

    In the before the last week of September, one of my bosses told us that our salaries were going to be cut a 15% till January. At first, I agreed... but day after I asked for a compensation for that money, because I don't think is fair she cuts my salary 5 days before get paid, and this is the second time it happens in two years, and I'm the only employee hired for so long, so I asked for days off, get the money back when the company starts to run better or whatever, she denied me any posibility, so then I give her my notice.

    But now I have 3 months ahead, and the work atmosphere is horrible :( They don't plan to hire anybody to replace me, because they have no money at all, so there is no point for waiting for a knowlegde transfer.

    So, is there any chance to leave before three months? What could happen if I leave before that?

    Bad reference obviously; beyond that it would depend on how senior you are, what knowledge you have of the company and where you're going next.

    You can also look it the other way around; you can do pretty much anything you want (short of illegal things) at work since disciplinary will take to long to get you fired.

    Only recommended this if you don't plan to use them as a reference though; if you are then you need to play nice and start applying now. Once you've got a job lined up (i.e. a offer has been made to you) you can start talking about using holidays etc. to reduce the notice period.

    If your contract states you need to work 3 months notice if they wanted they could sue you for breaking the contract.Most companies don't bother but if you left them in the lurch it could be a possibility

    You could offer them one months notice. They then have a choice to accept that and get someone who is willing to work hard over that handover period, or refuse and have you not cooperating in the handover.
    Even if you left early the chances of them sueing is slim.

    You should check the terms of your contract.

    Contracts often say the following:

    Any change in the terms of your contract must be notified to you in writing.

    You may write a letter back objecting to the change in terms of your contract.

    If you object and your employer wishes to still make the changes to your contract they must wait a period of time equal to that of your notice period.

    That's what my contract says, i.e. if they want to change any of my terms, they must wait until a time when I could have handed in my notice and left.

    I know it doesnt help you to leave any earlier but at least you would be getting paid more. You sould check your contract and see what it says.
