Junk Mail and Flyers

    Like many people my mail box is full of junk mail these days and everywhere I park now I get flyers on my car advertising builders and car wash services etc. Out of interest is there any legislation against the flyers in particular. Its a form of littering when the wind picks up in an outdoor carpark for one thing and the amount of junk mail that goes into my green bin is a disgrace.

    If someone in the US hasn't already succeeded in getting a $100 million dollar award for mental stress arising out of having his mailbox stuffed with flyers then I don't see how you'd have a case over here since they tend to lead the way in this regard.

    Companies would say that posting flyers is a legitimate was to promote their business in specific localities and since most of the flyers will end up in green bins, what's the problem?

    If I want a flyer I take it from the person handing them out, if I don't want it I don't take it.

    Why should I dispose of flyers forced upon my property when placed on my car? Would I be better off driving off with it on my windscreen and allowing it to come lose or would I then be guilty of littering?

    It's a fact of life that you've have to live with. The people who post these flyers in your letterbox or under your wiper are students or immigrants who are prepared to work for very little return, there isn't really much point in tackling one of them about the subject. On the other hand I believe my An Post postman occasionally delivers flyers to me with my regular mail so maybe you could have a word with An Post?

    Of course you could try to sue the ultimate product or service vendor but don't expect a lawyer to take on the case without a large cash deposit because nobody will take it on on a 'no foal, no fee' basis.

    Sorry I wasn't actually thinking of sueing, strange culture that we live in that people raise that word all the time to solve matters. I don't want to particular help someone keep up repayments on a property development in Brazil.:rolleyes:

    So if say a litter warden finds a number of these flyers in a carpark, can he not issue a litter fine to the said company on the flyers? Just as supermarkets are fined for trollies dumped by customers.

    Posting flyers on a vehicle without the owner's permission is illegal under the Litter Pollution Act 1997 (and subsequent amendments):
    Sect 19
    (2) A person shall not place advertising material on a mechanically propelled vehicle in a public place without the prior consent of the person who owns, or is in charge of, the vehicle.

    My postwoman often delivers flyers from nearby supermarkets.

    Why would an Post cut off a reasonably luctrative revenue stream for themselves? Anyone can pay An Post to distribute "Junk Mail", there is even an online price calculator somewhere on their website!

    It isn't the postman doing a solo run for a few bob on the side!

    And it sure isn't illegal, and i'm afraid there is nothing you can do about it!

    Our local authority enforces the law which prohibits the flyer from being placed on the car.

    They use 3.2. of the litter Act for people handing them out in the street if the flyers are found dumped/littering on the ground.
