Refused Jobseeker's Allowance

    Dear All,

    A friend of mine was recently refused for jobseeker's allowance due to not satisfying Habitual Residence Conditions. As deciding officer said on the letter he sees no reason why my friend should be staying in Ireland. Just a bit of a background: he is Latvian and had been leaving and working in Ireland for the past 4 years. He has a daughter of 3 years who is Irish, and she lives with her mother. He was applying for jobs for a good few months now, but still no luck, but he is genially seeking. Since he has only experience in landscaping and due to current economic climate you can imagine its not going easy.

    It makes me mad, as I’ve heard cases where people go back to their home countries and still receive allowances, people sitting at home young, able to work and have jobs offers but couldn’t be arsed as they receive allowances.

    His former employer promised that he will have work for him in a few months, so to survive these few months he needs to get this allowance. He can appeal this decision and I think he should as I believe he has a good reason for staying here – his daughter.
    He is devastated that if he won’t be able to sort things out soon enough, he will have to come back to Latvia for a few month and the thought of not seeing his daughter is killing him.

    I was just wondering if someone had appealed welfare decisions on a similar basis and would advise how to put all this in a claim form and what documentation would be helpful to attach, like child’s birth cert, passport?

    I’m desperate to help him and any advise will be much appreciated.

    Did your friend apply for Jobseeker's Benefit first? AS he has been working here for 4 years, does he not have enough stamps built up to qualify?

    Otherwise your friend can appeal his JA claim.

    He can appeal his decision and while hes waiting on that to be sorted he could possibly get supplementary payment from his local Community Welfare Officer....not sure of the ins and outs of it though but its worth a shot!

    My friend got refused and he appealed it but when he went to the cwo they would not give him nothing, the officer said while its on appeal they don't give out money.

    He was here 3 months and he got a bird up the duff? I am presuming he split from the mother soon after? Is he providing the mother with payments for his daughter? Can he not emigrate and get a job?

    Sorry for not getting back to you before and thank you so much for all your replies.

    Yes he was claiming Jobseeker's Benefit before for i believe 9 months. He was providing mother with payments every two weeks, as one week she would stay with him and other with her.

    I was advised that it could be a very good idea to contact citizeninfo offices, as they will advise on how to process with these claims and also if you would be called for an interview they can come along.
