If cctv goes missing

    Just wondering what would happen if an incident took place in a night club and CCTV footage was needed but it went missing or was copied over. What case would there be? Would witnesses be taken into account? What if they had consumed alcohol?

    It all depends entirely on the circumstances of the specific case . Witnesses are still important , the fact that they had drink consumed is something that might be used against them but it does not nescessarily negate their evidence.

    The Gardai could take issue with the licensee but that's separate from them deciding to prosecute or not prosecute another person.

    The lack of CCTV would not aid a prosecution but it would not eliminate any chances of a prosecution either. If the witnesses were drunk it would make them in some way less credible but not incredible. It all depends how drunk they were (for instance I was drinking at a christening last week and I was drunk but I can remember everything clearly so I'd like to think I'd have made a good witness if something had happened). If there is a sufficient (one may even be a sufficient number - the injured party that is, but the more the better) number of credible witnesses then a prosecution will most likely take place.

    I guess what I'm trying to say is that it all depends on so many variables!!!

    Many variables exist in every situation. If you're asking, which I doubt, on an academic level your question has been answered.
    If you're asking from a personal point of view, then you should contact the Gardaí and report the matter. If you're worried about being arrested then you should probably also contact the Gardaí :P

    CCTV evidence is very overrated in my opinion as the amount of premises you see with CCTV cameras & they are still the victims of crime. A lot of businesses buy CCTV systems & then train one member of staff to deal with it & when the staff member leaves, nobody knows how to use the system.

    Then the system the premises buys is out of date before its even installed & it's never upgraded. If the money is put into the system, they can be invaluable in gathering evidence but most companies see it as once off purchase & thats the end of it. It can be made worse by the fact, the systems can automatically deleted before the evidence can be used. They provide a false hope of good evidence in my opinion.

    Well thats my 2 cents worth anyway.

    If an incident took place in a night club ?

    Would depend on the incident.

    If CCTV footage was needed ?

    Would depend on who it was needed by. If the nightclub was told it was needed as evidence in a criminal case there could be problems for the licence holder. If it was a civil case and there was an order for it to be produced which was notified to the licence holder there could be serious issues as well.

    Would witnesses be taken into account ?

    Always.

    What if they had consumed alcohol ?

    It would be a strange nightclub if some or all of them hadn't. Their credibility would be affected if it was established that they were intoxicated.
