Going from Full time to part time - told contract will change.

    OH has requested part time (3 days per week)
    This has request has been accepted but told that her contract will change to part time. She hasnt agreed to this yet.

    She had worked 5 years full time.

    Can she protect her 5 years full time right and request a continuation contract of some sort?

    She is well liked by the company and is returning after maternity leave.

    Of course her contract needs to change since her existing one says she work's 40h a week; that don't impact things like redundancy etc.

    Her contract would need to change, unless the 2 days were taken as Statatory Parental Leave, but this needs to be agreed by both parties, and the employer in under no obligation to agree, it's usually taken en masse, but they must give it before the child is 8. (again usually as a bloc period)

    Where I work can accomidate some requests for it to be taken as one or two fixed days a week, and as it's statutory the employee retains all rights and benefits, this is however, unpaid.

    Any other alteration would require a contract change as the work pattern would change.
