abandoned car in street!

    Hi all,
Have another question, that hopefully someone can shed light on.
There is a car in our street, that has been there in the same place for eight months. I pass it every day to work.
It is covered in tree sap and bird poo, and who ever owns it has taken off the plates, presumably so they wont get a ticket or clamp.
I wouldnt mind giving the car a good home, and have left a couple of notes on windscreen asking owner to call me, but the notes are still there after 3 months.
It may even be the case that the owner has just left the country and left car behind and taken off plates. Is there anything I can do?
If I call the council will they just simply remove it, or can I request to take car? Is there some form of a vehicle squatters rights?
    Thanks, Spacekiwi.....

call the council, report it abandoned and get it shifted if it's on public property. If it's in a privately-managed estate, call the managing agent.

if you want to take it move it into your driveway and keep it there until its been 'abandoned' for a year and a day, ten i do believe you can claim it, what kind of car is it as a matter of interest

+1 good advice, council have to take it if plates are off!

doesnt work like that for cars, only for objects like a bicycle or camera etc. that you find!

I wouldnt go moving it myself unless I make contact with the owner.

Plus the owner might be an unsavoury sort of character who might not take too kindly to seen his motor parked in OP's drive if he came back to collect it. Unlikely he would with the time that has elapsed since car was abandoned but its possible I'm sure.

Aye. The owner could be in a holiday provided by the state in one of it's 3 star prisons...

Does it have valid tax and insurance?

It's a windy night, the licence plates may blow off tonight ;)

    But first check for tax

What type of car is it, have often wondered about this.

Have come across a few nice cars abandoned in housing estates.

OP asked if he called the council will they just take the car, answer is the council have to take a car if there are no number plates fixed to it.

maybe you should have another read of the my posts yourself Anan before you go commenting on them!

mathepac suggested calling the council to have the car removed, you quoted this post and said '+1, good advice'. It's clear from this that neither of you had registered that the OP wanted to keep the car. As an aside, if you've an issue with moderation then PM the mod in question rather than bringing it up on-thread, as this is a bannable offence.:)

I'm in the same situation. Lovely 98' renault sitting in the estate except this one hasn't been touched for roughly 3 years. Does anyone know how i could gain ownership of the car? one of the plates is already gone so if i called the council and they took it away what sort of steps are then involved in retrieving the car?

why do they take plates off ?
can't the cars be traced by the VIN number ?

Go down to wherever they store the cubes and see can you pick it out.

i really don't think you can claim an abandoned car. For all you know, the car has been involved in some sort of illegal activity and has been abandoned and the plates removed (though it is still traceable from it's VIN number, but who's to say that's still there either).

As far as I'm aware, council will have to take it and if it's not claimed (by the owner), then it'll be scrapped.

Sweet jebus, I didn't realise the country had got this bad. I drive a banger myself but please don't tell me it's a boggo megane/laguna/clio untouched in 3yrs that you want? It's not worth the new set of tyres it needs..

Found this in the Statue book about abandoned cars under the Waste Management Act 1996.
    7) Where a vehicle is removed from land by a local authority under subsection (4), and—

( a ) subsection (5) (a) does not apply in respect of the vehicle, or

( b ) the name and address of the owner of the vehicle cannot be ascertained by the local authority by reasonable inquiry, or

( c ) the said owner fails to claim the vehicle and remove it from the place where it is stored within 4 weeks of the date on which a notice under subsection (5) has been served on him or her,

the vehicle shall become the property of the local authority
    .

From the looks of this you should be able to buy the vehicle off the council after they remove it.

But I've also noticed that the councils have been shirking their responsibility with collection of abandoned vehicles

    (4) Without prejudice to the provisions of sections 55 (6) and 56, and notwithstanding the provisions of any regulations made under section 97 (inserted by section 63 of the Road Traffic Act, 1968 ) of the Road Traffic Act, 1961 , a local authority may enter on any land upon which a vehicle has been abandoned and remove the said vehicle; a local authority shall not, other than with the consent of the occupier, enter into a private dwelling under this subsection unless it has given to the occupier of the dwelling not less than 24 hours notice in writing of its intended entry.

The councils should be removing abandoned vehicles from private estates and not forcing the Management Company to have to pay out to have it removed.

There's a 03 Mondeo abandoned on the Boreenmana Road in Cork. Been there now for about 3 months. Looks fine to me, even if it had a blown engine, it could be easily sorted ... the mind boggles.

  • Closed Accounts Posts: 17,733 ✭✭✭✭corktina

why would you want an abandoned car? you can buy old bangers for nearly nothing legitimately as it is.

I would imagine the Council would be looking at you paying the recovery fees at the least if you wanted to take on ownership.

We have the same problem here, polish gone back home, what usually happens if somebody wants to get rid of a car that is lying around the place, they break one of the windows, it looks vandalised, then somebody sets fire fire to it, then the council come out and take it away, problem sorted.

thats only if its a non-runner ....if it runs it will be taken for a test drive !!!

It is indeed a megane! Looks absolutely pristine though. No joke! Interior and exterior like new. Im looking for a bit of a bucket to transport materials as part of the work im doing and my car isnt suited at all and getting steadily ruined. Just seems insane to have the council cube it when I have a use for it. obviously theres no way of knowing until its taken whether it has a history or what state its in under the bonnet but if the fee's involved in recovering it were relatively small it seems like it would be worth it. (seen as i also have about 3 sets of tyres out the back :p)

Fair enough:), if you already have tyres you might get lucky with the rest of the car and getting it NCT'd etc. T'would want to be a more interesting car before I'd chase it up tho!

How exactly would these abandoned cars be started besides hotwiring? Are the keys left in it too?

D'oh! Good point! Maybe a new key could be cut/coded from the VIN but it's another hassle/expense to add to the list

There was a Punto seemingly parked because of the snow on the Ballycullen road last week (probably Wednesday or Thursday). Ridiculously bad place to park (at a corner on an uphill), but everyone presumed it couldn't get up the hill so the owner had left it there, like so many others.

Come Saturday morning, number plates were gone, all the windows were smashed in (traffic cone rammed through the windscreen). I drove by it later on and someone had opened the bonnet and stripped out a few bits (battery and whatnot). The bonnet was then closed again later on. Very odd. Maybe the owner decided he'd had enough of it and wanted to trash it before letting the council take away.

Or maybe someone struggled up the hill and scumbags then thrashed the car.

I would have said that except that there were loads of cars parked on the street and none of them touched. It's also odd for scumbags to take the plates (rather than just smash the windows and kick in the panels)
That someone came back and opened the bonnet and took out parts in the middle of the day, also doesn't suggest a random trashing.
