sold my car

    i sold my car to a dealer well a tuning shop it was an rx7 with a few mods for 2.5k i told the chap it wasnt running it had an electrical problem and wont start basically i had tried but gave up so he said he would take it off me for the bill of the work he had done to my other car. now 3 nearly 4 months later he is calling me 8 or more times a day and he has even called round to my family home looking for me to get the car totally rewired even though he bought the car not running off the back of a trailer which i footed the bill for to get the car down to him

    ive called a few mates in the trade and they all said tell him to go and jump sold as seen i told him the problem with it and now he is complaining to high heaven its not what i told him and the car is use less to him as he cant get it started and running

    i know nothing of this sort of thing and i am a bit intimadated by him calling to my house i rang the gardas to find out if they could do any thing and they just said if he calls again to the door to call the station and they will send a car up to my house

    please any help would be a huge help im even thinking about calling a solictors on it

    If a dealer buys a car from a member of the public, there can be no warranty involved for obvious reasons. It is very similar to a private sale - buyer beware.

    I'd agree with your friends in the trade, tell him that if he calls to your house, or rings your phone again you will be bringing charges against him for harrassment.

    Was there any paperwork with the deal or was it just a cash job?

    I would in no uncertain terms tell him to stay away for you and your home and if he wishes to have further contact he should do so through his solicitor.


    It sounds to me like he is hard up for cash and now wants the money for the original job which you paid for with the car.

    Don't do this OP as much as it may appeal

    Stay calm and threaten the legal route and let him rant if he wants.

    It would weaken any argument he will ever make if you can say he gave you a foul mouthed rant without reply

    Tell him clearly and firmly that it is his car and his problem now. Keep a note of any contact you have with him, dates, times, etc. in case this goes down the legal route.

    Pretty much in agreement with the replies thus far. It would seem the car was sold as seen as a non runner. It would be assumed that the motor trader would or at least should have a much better knowledge than you seen as he is in the trade...hence leaving you in a stronger position. It seems you entered into the contract in good faith and disclosed the problems with the car as you knew them at the time. I reckon things aren't going well for him and hes just chancing his arm to get a few quid out of you.

    Might be no harm answering the phone though as it seems he wont just go away from the way your talking. At least it may put a stop to him calling to your house and freaking out your family. Is it possible that he may have something else on his mind such as car was not transferred into his name for example?

    i was just a bit freaked out with him calling to the house and harassing me on a saturday i was happy out playing call of duty and he comes shouting at my front door my mate was here (big ginger bloke) he took two big step back when he popped his head out the door to see what the shouting was about i kinda figured he didnt have a leg to stand one but wasnt 100% sure

    As someone in the trade he doesn't have a leg to stand on, even if you didn't tell him about the problem he is assumed to have the expertise to suss out the car if, for example, he was taking it as a trade-in. As an earlier poster said, the law is on your side so the fact that you did point out the defect means that you are 100% in the clear.

    The only time a private seller can be called to book is if you sell a car in a private deal to a private buyer and you deliberately conceal a fault which you are aware of but since that's virtually impossible to prove it effectively means that when a private citizen offloads a car there's hardly ever a comeback.

    all he asked for was the car and the log book so i dropped both down to him then 3 and a half months later this come out of the wood work at me i didnt sign the log book as he said he was going to put it to his friends name who was going to buy it from him once he fixed it now he it tell me i have to rewire the car for him and pay for it out of my own pocket i dont have a job and i dont feel thats fair as it was sold as a non runner like
