need advice, I have recently been laid off. indefinately. I have an RP9 form i can use to claim redundancy, but am afraid to sign in case i lose my job seekers benefit, and mortgage protection. If i sign, will it be classed as me taking voluntary redundancy, and if so, how long can i be kept on lay off by my employer if i dont apply for redundancy, Thanks

signing an RP9 will not impact either your mortgage protection or benefits. Firstly if you sign and return to your employer he has 4 weeks within which he can reply that there is further work for you but there must be at least 3 months of it. You are therefore, in effect, only asking for it if there is no constant stream of work coming up. Also the signed RP9 doesn't go to social welfare but rather the dept of enterprise with your RP50 (redundancy form) and these government departments are not co-ordinated. So no issue really

One thing to remember is that if you do sign it you lose the right to notice pay although your employer may be generous and pay it
