My wife, who was on a 3day for nearly two years now, has just been let go from her office job and we know that her tasks will be split up between another office person in a sister company and another person in the same company but who has a totally different line of work, both have been there longer than her, is this legal?

has she been made redundant or let go?there is a major difference.

if she was made redundant then the companies action of splitting her work between others is correct as you wife's role within the compnay no longer exists.

If she were let go, as in fired, given her two weeks notice, then that wrongful dismissal which is another whole other ball game

Hi, she was let go till the new year. Jan, Feb or even March if things dont pick up but we are fairly certain she wont be called back in at all!

well thats where she better get back and demand redundancy, what they have done is wrong.

The lay off or short time has to be for a set time. If the time element is not set then the staff memeber has the right to claim redundancy but must do it within a set period of time.

I would recommend a chat with citizens advice(they are excellent) on this matter as there are procedures that the employer has to follow and Im hearing employers are using this tatic to prevent them having to pay out redundancy money by keeping staff on the long finger.

Thanks for your help on this. We will get onto the cit. info, just chatting to my wife about it and she would like to go back to the company but is really upset that her work load is been split between different people, so they can do that?
