Claim Car tax back?

    Recently i was in 2 separate crashes and as a result my car is being written off and im giving it to the insurance company for parts..Its a 99punto that has tax on it until january 2011.I was wondering is it possible to claim this back..

    Yes. You will have to get an End of Life certificate from the insurance co/dismantlers.

    If the insurance are writing this off and paying out on it to you, then I would expect them to include the value of the tax in your settlement. This happened to both my wife and my dad whose cars were written off. Remember that they might be writing the car off insurance wise, but it might not actually be scrapped.

    Also, I think there has to be at least 3 months tax left on the disc, and yours will only have 2 months (if you mean that the tax is up at the end of December, not the end of January).

    you can claim it back, but when you apply for the tax back you must have a minimum of 3 months tax from the following month of which you apply.

    so you need to gather the required documents and lodge them before the end of October in order to claim back Nov, Dec and Jan tax.
    Refunds of motor tax
    It is possible in certain circumstances, to claim a refund of motor tax. Your application for a refund, should be made directly to you local motor tax office, on Form RF120 (pdf). Circumstances where you may claim a refund of motor tax include;

    The vehicle has been scrapped/destroyed or sent permanently out of the State,
    The vehicle has been stolen and has not been recovered by the owner,
    The vehicle has not been taken out or used in a public place at any time since the issue of the current disc,
    The owner of the vehicle has ceased, because of illness, injury or other physical disability, to use the vehicle,
    The owner of the vehicle has ceased, because of absence from the state for business or educational purposes, to use the vehicle,
    The owner of the vehicle has ceased, because of service overseas with the Defence Forces, to use the vehicle.

    Tax discs must be surrendered immediately as refunds are generally calculated from the first of the month following the surrender of the disc. A minimum of three unexpired whole calender months must be left on the disc when surrendered. Where a vehicle has been scrapped you will need a certificate of destruction issued by an End-of-Life Vehicle (ELV) Authorised Treatment Facility.

    Someone crashed into me(not my insurance company).They are taking the car off me.the car has been undriveable since the 18th of september.where do i apply to and i need to do this quick as the car is going to be taken off me this coming week

    This is very true (happened to me very recently 11months remaining), when the assessor is writing his valuation, make sure to ask him to include what you will be loosing out on (in this case tax).

    If the car is to be permanently removed from the road the insurance company may issue you with a certificate of destruction but this can take time and you won't be back paid.
