Putting deposit on house but probate not through?

So my partner just bought a new house (well, 160 year old new!). The deposit of 5k has to be put down tomorrow. The probate has not yet come through yet even though the house owner died last December. It is due to come through next month. Will this hold up the house sale or will things tick along in the meantime? It's a cash sale so we were hoping it would move quickly.

Another thing, the family member who took over the sale of the house is not an executor. There's been a falling out between the brothers and sisters and they're not speaking  Should we be worried?

Not necessarily, usually in these instances there is a legal personal representative acting. Speak with your solicitor. Nothing becomes binding until deposit paid, accepted and contracts exchanged.

Deposit paid this evening and person who took over the sale has acknowledged their pleasure! (I know the family!)

Still a tad worried as there is definately a falling-out between siblings.
