Hi, I'm a student & I've got to do a project on a point of law I'd like to see changed. I decided to study up on why a catholic can't marry a divorced person in Catholic church, & why the church wont recognise the marriage if it does take place somewhere else. I don't know where to start to get good info on this subject???? Any help gratefully appreciated!!!

    Hi Martina,

Can i firstly ask why you chose such a narrow topic?

What angle did you think you would take when choosing this title?

I would suspect that your main focus would be on canon law? Or would would you delve into how divorce came about / legislation passed / constitution amended / how the government facilitated this etc?

Hi Joe, the brief was just to find point of law we had a personal interest in & would maybe like to see changed eventually. I'm not a legal student or anything so I just want to study the subject & understand it better. I would take the view that I would like to see divorcees marry in church & have it recognised

Well that is not state law, it is canon law.

So you will be on religious grounds here, and not points of law.

Thanks for that, I was thinking it was family law of some kind

Canon law has nothing to do with the state as far as I know(bar perhaps its influence)

yep, just read that its influence only. Pity, would have been interesting, now I've got to go looking for some other aspect of the law I'd change if I could. Very wide brief for a mature student only back at school a few weeks! Joys of it!

I remember having to do something similar as part of my degree. I chose to challenge the law on euthanasia. Thought it was a very interesting topic and was able to delve into it in some detail.

A good stop is the law reform commission as they release reports on how laws should be updated/changed. Good for discussing differing viewpoints. Your lecturer may want your own opinion by the looks of things so contrast the law reform's opinions with your own and give whichever report you choose a citation in your essay.

Hi Aphex, that website looks really interesting, thanks for the info. I'll admit to being a bit dazed though, so much legalese to sift through & form intelligent opinions on!!!!

Hi Martina, a very broad area of law with many topics in need of reform and plenty of articles and publications which critically analyse the law would be Tort Law. I would suggest doing your essay on personal liability for negligence, reading even the smallest amount on this topic will immediately show you the many many criticisms to be made of the current law.
