law about blocking exit

    Does anyone know what is the law regarding blocking an entrance to a house by parking in front of it. Is is a garda matter

    This seems to say it is not illegal in the UK. Position here anyone?

    blocking access is definately not legal...call the gards.

    does that apply in a private estate that has not been taken over by council? can the garda act in a private estate?

    if by regular you mean council yes.but the council have not taken over the estate yet as they are not happy it is all finished to their satisfaction. So does section 98 apply?

    It is a public place under the road traffic act. Sec. 98 applies.

    The council taking responsibility is a maintenance issue.

    If you are blocking someone entrance move your car know, if someone if blocking yours tell them to do so. Section 98 of the rta applies regardless of who is responsible for cutting the grass etc.

    Also since you seem to know about parking this is just a curiosity. Last week I saw a radio station outside broadcast unit taking up 3 or four wheelchair spaces in the car park of a shopping centre, with the centre permission i presume. can they do that or could a traffic warden/garda give a ticket.It would be private property wouldn't it so does the road traffic act apply there or do the centtre give spaces as a gesture rather than obligation

    That's illegal as the spaces are required by law and usually the amount required is in their planning permission. They should have been ticketed, it's hardly as if disabled people don't need to shop when some stupid radio show is on.

    Now if it was parent and child spaces they could park across them as they are a marketing stunt.

    [GA](2) A person who contravenes subsection (1) of this section shall be guilty of an offence.
    [GA](3) Where a person is charged with an offence under this section, it shall be a good defence to the charge for him to show that there was lawful authority for the act complained of or that it was due to unavoidable accident.
