Ebay: Item paid, for returned, replacement not received

Does anyone have any advice in this siutation:

I bought an item on eBay, which was posted but was defective when it arrived. I contacted the Seller via the ebay message facility and he agreed to accept the return and said he would post out another same item.

It's been a week now, and nothing has been received. I've sent him a message via eBay messages and also opened a Paypal dispute and am awaiting his response.

I have proof of postage for the returned item also.

    Good!

More than likely Paypal will be touch and ask for the tracking number and once they confirm it then you should get your refund.

Is that proof of postage a tracking number, or just a receipt? If you don't have a tracking number, and can't prove delivery, then you have nothing. It will be up to the seller to decide whether to refund or replace the item. Paypal will not intervene without a proof of delivery.

Negative feedback is the only thing you can hold over the seller, if you haven't already left feedback. Watch the time limits too. You have 45 days from payment to dispute a payment in Paypal. You must also leave feedback within 60 or 90 days, after that you can't leave feedback.

Thanks for the advice lads. The Seller has assured me he will send it out by Registered Post this week.

He has to send it by registered post to ensure delivery is traced .

If you are satisfied with the new item , you can then close the dispute with Paypal .

However , I suggest you do not leave him feedback until you first receive feedback from him. - and even so , its best to wait a week or 2 , to give your new item time to settle in .
