Redundancy application rejected!

Ive applied for the voluntary redundancy package which my company currently has on the table. Final decisions will be made within the next 2 weeks.

I had a long chat with my new boss during the week and I have a feeling that they will reject the application. I think he sees me as being too valuable a member of his team to lose and counts on me etc... Truth be told I am having difficulty in coping with the pressures I am being put under and this is severely affecting my whole life. Ive explained this to him and he understood where i am coming from.

I know the company has the right to reject any application. However what are my options if they do? A colleague of mine has told me he will go on long term sick leave (stress related etc) to try and get the package from them eventually. Im not sure of this approach but the thoughts of working there long term can drive me to it.....

Can I ask the union to fight my cause? Do i plead with my boss?
I cant just quit the job for financial reasons.

    Any thoughts/advice/opionions etc....

Why not talk to the citizens advice or a solicitor?

Put down on paper what your job entails and show your boss and maybe your tasks maybe reduced through delegation?

Big step to seek redundancy I hope your boss doesn't hold it against you. If you are suffering from stress, go to a doctor. Best of luck

Went to the docs around 2 months ago and he told me to take 3-4 weeks off. Told him i couldnt as i would effectively be signing my own P45 in the job. So i took 2 days annual leave.

In fairness to my boss i dont think he will hold it against me. Time will tell though. Going down the legal route is my last resort. Id rather not to be honest....

Can he not be let go without VL if he's continuously out sick? Sounds risky, not to mention very unprofessional.

I don't know what a solicitor can do - as you said, they're completely within their rights to pick who they want to get rid of, and who they want to keep. You can try and suggest alternatives to them, but remember that they have to make sure that they're legally above board in deciding how to get rid of people. What might seem like a fair solution to you, could be a dodgy one to them.

Unfortunalty as you are applying for voluntary redundancy the company is well in their rights to refuse it to you, the key word here is "applying".

Going long term sick is not an option - if the company can prove you are unable to perform your duties due to a long term illness they cam let you go with nothing, this is a vary dangerous game to play.

My advice is play it safe, if you get the redundancy great, if you don't then at least you still have a paying job and your not on the dole.

Well as suspected my application was officially rejected this afternoon. Boss was upfront and honest about it and said he was the one who made the decsion. Hes couting on me etc.....

Dont know if to leave it there or to take it any further. If i take it any further i could jeopardise my career and get the boot without getting the package so maybe reluctant to go down that road.

    However

Not sure how much longer i can take with the job and all that it entails.

Maybe I simplify the issue too much, but why not just looking for something else and then give your notice?

I'm guessing that the OP would like a package if at all possible.

Exactly. I have 11 years service and Im quite well paid but cant run the risk of going to another company and something happening which results in it not working out (company folds, reduces in size, last in first out, job not what i envisaged etc)

On another note my mate has got the package and is delighted and im gutted.

Leaving the company without a package is not really an option - far too risky under the current economic climate. Id rather be paid well, be able to provide for my family and put up with the crap I get than be lowly paid, struggle to pay bills and suffer even more so because of it.

Guess I'm stuck for the time being.....

    Hi,

How has your situation worked out 3 years on. I am in exactly the same situation now and am wondering what options I have.

    Cheers
