Issue with Ebay and PayPal

    Hi. I bought a video game in July through Ebay which I never received. It was covered by PayPal. When I first contacted the seller on the 2nd week, he told me to wait 28 business days after payment and then contact him again. I did that and he promised to make a refund. A few days later I asked him if he had made the payment and he asked me for my address, which I gave him. That was all within the 45 days that PayPal provide cover. On the 46th I tried to open an official case with PayPal but I couldn't because I had missed the timeframe. I contacted them and they told me that there's nothing they can do about it. Now I know from my experience in business law classes that when someone makes a written statement with a promise, they are legally obliged to do so in terms of trade. I don't get it why PayPal wouldn't take that on board and help me. Anyways I remember that there was some sort of agency that deals with small claims (the money that I lost is about 30 euro) and they would take the case in your name. Is there anyone that can give me more information about that and also if anyone is more into law if they can tell me if I have any legal rights here. Please help me. Thanks

    The T&Cs for paypal are pretty clear on this, and eBay also generally have no liability.

    You can take a small claims case against the seller if he is located in Ireland (and not a business seller).

    I don't know about the small claims court in your case but another option is a credit card chargeback if you paid Paypal using a credit card.

    I've had issues before with getting money back off Paypal. If you paid by credit card get onto your bank, ask for the number of the dept that process credit card charge backs and get onto them. They'll want all info so provide them the info of the sale and correspondance with the seller. It's not a quick process but it's better than nothing. I used to buy a lot through eBay so I've done chargebacks twice and I know other people who've done it without a problem.

    Always try to pay Paypal using your credit card. It's an extra bit of protection for you. The Paypal protection isn't always that great.

    The seller gave you the run around by not sending the game and then asking you to wait 28 days! - NOTHING takes 28 days these days unless its the slow boat from china.

    He then continbued to fob you off and you still believed him.

    Take it as a €30 lesson in finding out that a huge number of ebay sellers are scam artists and if it happens again open a dispute with paypal IMMEDIATELY - you can close the dispute at anytime and the sellers reputation won't be affected if its resolved properly.

    It would be a lesson for me, that's for sure. It's not about the money - 30 euro isn't that much. It's about justice He had very good reputation actually over 1000 points with no negative feedback for the last 6 months. Anyways it sux that he decided to act like that. I wish there was something I could do. He is actually registered in the U.K. so I thought I was covered by law if something would happen (not some ****ty country where there's no actual working laws).

    As mickoneill30 said contact your credit card company and do a charge back, it does work, did it myself and got my refund very quickly.

    You can leave negative feedback, that's all. What you should have done was ignored his 28 day BS and started a dispute in Paypal after about 10 days. That is more than enough time to allow a package to arrive from the UK.

    Is he also a registered business? If so, you are covered by consumer law, but no one will force him to refund your money. Only a court could do that, and I'm not sure how that work across borders.
