I have an iPhone 3gs with O2. Recently I had to send it away for repair to Apple because the headphone jack went. Apple sent me a brand new iPhone. It has been jailbroken and unlocked (ultrasn0w) since but is it factory unlocked anyway? Seeing as apple sent me a new one?

uninstall ultrasn0w and put in a vodafone sim and see if it still works.

Its not a "brand new phone" but its refurbished. Basicly it looks brand new, no scraches or anything. But internal stuff has been used by other iphones. Basicly it works perfect like a brand new one, they always intall a brand new battery on the refurbished ones. and the warrenty left on the old one, has been moved to the "refurbished handset", if there is no warranty left on the old one, they refurbished one come with additional 2 months warranty (if you already have another 3-4 month left anyway, that doesn't add 2 more months in this case). They also move the profile from one phone to the other. so if your one was locked to o2, then the chances are that this one is also locked o2 aswel. Because the previous profile you had was blacklisted- o2 only. Could be in some odd cases that they have you handset whitelisted. The only way to check that to remove the unlock software (ultrasnow) you don't even need to restore/remove the jailbreak to test it out.
