Joint Tax Assessment?

    Hi

    I'm just wondering about the legalities of this situation.

    You have a married couple, who are being jointly assessed for tax. IE: They are both named on the same tax douments.

    One of the persons in said marriage goes AWOL and is no longer living in the family home with their partner.

    Am I right to assume that they are no longer entitled to joint tax assessment?

    Still entitled until they get divorced.

    Either partner can elect for seperate assessment at any time, married, seperated or divorced.

    They are even entitled to remain on joint assessment when they are divorced believe it or not. (S 1026 - as long as they meet certain conditions)
