Speeding Fine

I received a speeding fine in the post, stating that on 30th June I had been caught speeding. There's a mximum of 56 days from that date to pay the fine. I calculated that 56 days from June 30th was today, 25th August. When I went to pay it today, I was told that the 56 days has lapsed and now I'll be getting a summons (and better hope for a nice judge). Anyone had any expierence of this? Am I missing something? If I subtract 56 days from today, I get June 30th! If I add 56 days to June 30, I get August 25th! Why couldn't I pay the fine?

I thought you had 56 days from the day you the letter, not the day of the offense? I know the points only take effect when you get the letter as well. They have up to 6 months to process the case, so it would seem a bit strange to give you two months to pay when you mightnt get the letter for up to 6 months after the date of the offense!

Maybe not, but he couldn't have got the letter on the day of the alleged offence!

No, the points take effect from the date of the separate letter telling you they have been applied.

Its not the same letter, no? Oh. Either way, its not from the date of the offense anyway!

I got the letter in July sometime, but the offence occured on June 30th. In the letter it states 56 days from the above date (i.e. June 30th) to pay. By my calculation, 56 days from June 30th is August 25th, that's counting July 1st as the day 1. Maybe the day of the offence is day 1? On August 25th, went to pay the Post Office (as the payment goes through immediately) and got a receipt stating the 56 days had lapsed. They couldn't accept it. They just said that it can't go through. Thought someone may have heard of this before.

i did hear of this before, it's bureaucracy in practice, it's the simple rule of thumb that comes naturally to people who sit behind a desk or counter, when asked a question you need to clarify - just say NO

surely its 56 days from when the letter is issued not when the speeding took place?

Just go to the garda station and offer to pay, if they wont let you ask for a written record from them of you presenting to pay.

I take it you were not framed up and you were speeding !

    well if so ....................

why did you wait till the 56th day to pay ?

could you not have paid on the 54th day ?

or maybe not only were you speeding but you were being smart and wanted to wait till the very last day to pay .................... lol

like the copper who gave you the ticket is going mad for them 56 days waiting on your cash lol

well I guess they are getting the last laugh

Go to a garda station and have a chat with them about it. Im 99% certain you have 56 days from when you recieve the letter, not from the date of the offense. Like I said, it doesnt make sense to have it from the date of the offense considering they have up to 6 months to process it, and by the time they process it the 56 days could well have lapsed.

You probably should have paid it sooner. You've had the letter for almost 6 weeks.

I would imagine your ok. I think the guard needs to manually picture your car breaking the speed limit.

The 'above date' is the date on the letter, not the date of the alleged offence.

Just go to any Post Office and pay the fine, unless you want to go to court and fight it.

I contacted the gentlemen in Thurles, who kindly informed me that, it was 56 days from June 30th (inclusive) and not July 1st, as took I it. So, August 24th was day 56 and not August 25th. My bad. Off to court with me so......

FYI, I would have paid within the first 28 days and then the following 28 days if I had been able to, but due to some circumstances I couldn't.

Are you sure 30th June is the date of the offense or is the date that the letter is dated? If its the former (the date of the offense) then they are wrong to say you have 56 days from that date to pay.

You have 56 days from the day the letter is dated (as in probably a day or two before you recieved it in the post) not the date of the offence.

Presumably, 30th June was the date of the letter, given that the OP has been on to Thurles.

My Husband is in the same boat.. He got stopped while using his mobile phone.. Incident happened in March.. In the middle of renovating our home, sometime in May letter arrives, i don't thinks it's important (no Garda stamp on envelope) so i throw it with what i would say was the junk mail:eek:.. Didn't think twice about it, till our kitchen was ready and we were sorting it and came across a load of bank statements and guess whats in the middle of them the 'Fine'.. Straight away, we went down to the Post Office, even though we knew we were over the 56 days, but they could give us a rejection slip, which if you want the Judge to think you did make an effort in trying to make a payment, you will need this slip..

Court appearance was this morning. Solicitor infomred the judge the that I attempted to pay the fine but it wasn't accepted, to which the judge replied, "What do you want me to do about it?" Here's when I thought he was going to throw the book at me, but instead he threw the case out :) No fine and No points! Happy days!
The judge said, "If your client attempted to pay it and it wasn't accpeted, then he shouldn't be here."

Your math is wrong! If you count the 30th as 1, then the 1st as 2, etc, 56 days leaves you at the 24th of August not the 25th. For anyone who has got a speeding fine, and I am one of those people, I suggest pay it asap. If you leave it longer then 28 days, I think, the fine is increased and then if you leave it untill the last day (and you did the math wrong) you can end up in court which is not a great experience. Just pay the fine and get it over with. Mine was for going 5mph over the limit at 10am on a empty road and it cost me E80 and 2 penalty points.

No fine and no points, but a day off work and the cost of a solicitor.

Not exactly a clean win. ;)

Yes its 56 days from the date of the first letter, you get 28 days to pay the fine @ €80.00, if not then it goes up by 50%. After you pay you will recieve a receipt acknowledging that, Then a few weeks later you get a letter from the RSA telling you the points will apply to your license 30 days from the date of this letter. If you dont pay your looking at a trip to see the judge...

3 years later when the points expire you'll recieve another letter stating that the points recieved on X for the offence X no longer apply you now have X remaining points on your license
