Management Company Question

    I'll make this short and sweet. Has a management company the right to hand everyone in our apts/house scheme a list with how much everyone owes every six months or so? Bit sick of hearing neighbours talking about one another around here about who owes what. I really don't think it's right. Your bill with a company is supposed to be private i would have thought? Thanks in advance.

    I would imagine their may be an issue with the Data Protection Act

    Has a management company the right to hand everyone in our apts/house scheme a list with how much everyone owes every six months or so?

    Each member of the management company (shareholder) is entitled to a breakdown of accounts, which would also include fees owed. They are also entitled to a list of company shareholders (members).

    So, when you combine those two rights, yes, the management company can send around a list of outstanding fees and who owes the fees.

    But, this may depend on the articles of association of your management company and specific details within your Lease Contract.

    So, They are entitled to tell everyone exactly how much each other owes, even though we are not shareholders?. Strange. In that case, what's next? the esb/upc etc? Surely our rights are being breached.?

    They should only be sending the information to the unit owners, who are shareholders/members of the management company.

    ESB/UPC, etc can't do the same, since it's a totally different situation and their clients are not members of the company.
