Been fired 3 times now

    Hello everyone,

    Ik started working for my Irish employer about 4 years ago. In the last 4 months I have been let go 3 times since they are in the process of closing the shop I work at.

    Every single time they tell me an hour in advance that this is my last day and then they call back 3 days later asking me to start to work again.

    Best example is last friday, many have guessed in what for business I might be employed by now, they told us around 16.00 that once again we where all been made redundant and it was final this time. Next thing the owner comes back from his holiday and decides to reopen the store in his infinite wisdom.

    I am simply sick of it and feel like im a doll being tossed around the room. What are my rights by now? Is this a normal way to end ur bussiness here in Ireland? Any help or advice would be apreciated since after being let go for the 3th time I simply do not want to go back anymore. How will refusing to come back affect my redundancy for instance?

    You are not being fired; you are being let go and it is a big difference :). Any way since you've worked there for four years you should have the right to redundancy and you should simply talk with your Supervisor/Manager and ask them to confirm, in writing, what your final working day is, the redundancy amount etc.

    That will be the only real way I can see it pushed to get the last working day confirmed etc.

    I don't know what business your employed in, I'm guessing construction so if your working on a C2 you are self employed and this would be seen as acceptable although not ideal.

    contact NERA www.employmentrights.ie they'll prob tell you that you have a case for unfair dissmissal... sounds like the employer is pulling the pish... dont stand for it, you have rights especially after 4 years of employment!

    While your employer is clearly in a pickle, you have rights as an employee that are not being respected. You have a right to consultation, notice, and 2 weeks redundancy for every year you worked, thats the law.

    Doesn't matter if they're a headshop, a builder or an IT multinational, same rules apply. Speak to NERA.
