Appealing a fine for putting rubbish out on the wrong day.

    Hi guys. I know i'm not allowed to ask for direct advice on this forum but if someone could point me in the direction of the statue in question so that I may research it myself, or suggest a place I could go to get direct advice i'd appreciate it very much.

    Today in the post, I recieved (as did a number of my other housemates, including about 6 that no longer live here and have not for quite some time) a fine regarding a recycling bin bag that had aparantly been left out on the street. I am assuming that they just went through the bin and sent out a fine to anyones name they could find in the bin to this address.

    The thing is, that the recycling bins are communal, and while I may have put things in the recycling bin while it was in my house, I am not responsible for putting it out in the street on the wrong day. Indeed, upon checking the dates, it is apparent that I was at my girlfriends house that night, and so could not have been responsible for putting the rubbish out.

    Being that the fine is €150 each, and my current bank balance is about €8, I am quite keen as you may indeed anticipate to avoid paying this fine, which I feel is excessive and unjust. In all my other dealings with dublin city council, including putting the bins out on the correct day, I have been fair and honest. I am surprised that there was no warning given or investigation of any sort as to whom exactly is responsible for putting the bin out? Can they really issue me with a fine without confirming in any way that I am the person responsible for the rubbish?

    Is it more sensible for me to appeal my case to them, or, being that I am leaving the country in October anyway, and the fine says nothing will happen for 25 days, to just ignore it and send it back with a "no longer at this address" before I leave?

    Will appealing the fine just result in more hassle for me than ignoring it?

    What case should I make if I intend to appeal?

    My god, they have this carry on in Dublin as well now? I thought it was just the really authoritarian places like Holland that did this

    Friends of mine got a fine from Dublin City Council. They contacted the local litter officer and explained what had happened. The fine was cancelled with a one last chance type of warning.

    Legally, you are responsible for the waste you create.

    You need to find out who put out the bin.

    Good luck with your problems (seriously). Learn a lesson - remove any personal identification from anything you throw away.

    Invest in a small shredder (c€20.00). Never leave anything with personal information in your rubbish. Ever.
