damaging shoes in the shop

    Hi there,

I recently went into a shoe shop looking for a pair of new shoes. I tried on leather boots and I scratched the leather with my nails. The scratches were deep enough and the shop owner noticed them. He accused me of damaging the shoes and he wants me to pay for them now. What are my rights in this kind of situation. Does 'you break, you pay' rule apply to me now?

    Please help!

Yes. You caused the damage, so you are liable.

    Lovely to look at
    Lovely to hold
    But if you damage it
    It's certainly sold

Used to see that in our local supermarket

    Pay up OP

Blokes shouldn't have long nails - consider it an expensive lesson! ;)

I like the rhyme but it strikes me as potentially misleading. Given that the shop would be suing in tort rather than on breach of contract -- a customer being mad to offer to buy defective goods -- surely the customer should only be forced to pay wholesale for the goods?

Two point, one point either way:

How could a shoe be scratch that badly with a finger nail?

How could a shoe be scratch that badly with a finger nail?

    (Yes thats two ways.)

Is this confirmed? I'd like to know in case I ever damage anything in a shop.

You'd most likely get a discount.

A certain breed of female would be known for purposely ruining tops with the makeup they were wearing while trying on tops and then expecting, and usually getting, large discount from shop owner.

I've read this a few times and still can't figure it out

Sorry, it should read "How could a shoe be scratched that badly with a finger nail?"

Either the shoe was of poor quality and easily damaged or someone went out of their way to damage it.
