JSB and Disqualification Period

    I was officially made compulsorily redundant on Friday 6th August and am disqualified from claiming Job Seekers Benefit for 1 week due to my redundancy payment.

    My question is, should I wait one week before registering my claim, i.e. the disqualification period, or will my disqualification only start from the day I register, i.e. if I register on Friday 13th August, I will be disqualified until Friday 20th.

    Thanks in advance for any advice.

    Register straightaway would be my advice

    It was so much easier to blame it on Them. It was bleakly depressing to think that They were Us. If it was Them, then nothing was anyone's fault. If it was us, what did that make Me? After all, I'm one of Us. I must be. I've certainly never thought of myself as one of Them. No one ever thinks of themselves as one of Them. We're always one of Us. It's Them that do the bad things.

    the disqualification is from the last day of your employment so register as soon as possible and when your claim comes through you wont receive payment for that one week

    Hi. I was made redundant on 31/7/2013. Went to my local social welfare office on 1/8 to apply for my job seekers benefit. I received e52,420 in total (this was made up of both a statutory and voluntary redundancy payment). My understanding from the Dept of Social welfare web page was that I would be disqualified for 1 week. When I received my decision on 27th august the deciding officer had disqualified me for 9 weeks. Rang office immediately but officer was gone on 2 weeks annual leave and supervisor refused to look at it for me. Am I right thinking that it should only be 1 week disqualification?. Also, to upgrade my skills I am hoping to go back to further education - course due to start next wed and I had been hoping to convert jsb payment to back to education allowance. My other query is - can I start college and then submit bte form once they have sorted out my incorrect 9 week disqualification. Thanks for any prompt replies as I'm in a real dilemma.

    You will not automatically qualify for a Jobseeker's Benefit / Jobseeker's Allowance payment if you accept voluntary severance. This is because you will have in effect 'voluntarily' made yourself unemployed. This could result in disqualification of payment of a Jobseekers payment for up to 9 weeks.

    If applied, this disqualification period will be deducted from your overall 12 or 9 month entitlement to receive Jobseeker's Benefit.

    You will have gotten a letter stating why you were disqualified for 9 weeks. You need to appeal this decision and need to do so ASAP as there is usually a cut off point of 21 days after receiving the disqualification. This should all have been on the disqualification letter.

    To qualify for BTE you would have to be on claim for minimum 78 days for a second level course or 234 days for third level course.

    Redundancy

    If you are under 55 and get a redundancy payment of more than €50,000 you are disqualified from claiming Jobseeker's Benefit. The table below shows how long you may be disqualified for. The length of the disqualification is at the discretion of the deciding officer (who can take your circumstances into account). Any period of disqualification is subtracted from your total Jobseeker's Benefit entitlement. So if you are disqualified for 3 weeks (which is 18 days payment) your JB claim starts on day 19.
    Amount of redundancy payment Period of disqualification
    €50,000.00 - €55,000 1 week
    €55,000.01 - €60,000 2 weeks
    €60,000.01 - €65,000 3 weeks
    €65,000.01 - €70,000 4 weeks
    €70,000.01 - €75,000 5 weeks
    €75,000.01 - €80,000 6 weeks
    €80,000.01 - €85,000 7 weeks
    €85,000.01 - €90,000 8 weeks
    €90,000.01 and over 9 weeks

    So you really should appeal the decision, with a payment over 50,000 you must have been working and paying taxes, prsi etc for a while and are entitled to it!

    If you have been awarded statutory redundancy and are entitled to a qualifying social welfare payment immediately before you start the course (note that it is not necessary to actually be receiving the payment) you can get immediate access to the BTEA without any waiting period. You must take part in the BTEA scheme within one year of getting statutory redundancy.

    IMHO: OP took voluntary redundancy & can be disqualified for up to 9 weeks. correct procedure is to appeal in writing asap, i'd say won't get much sympathy though...........>50K and into the dole office the next day....to avoid disqualification OP could have waited 9 weeks and then made claim as date of disqualification is from next working day after employment ends.............too late now though.

    to be fair to OP he has stated it was compulsory redundancy (1st post) and he received a voluntary redundancy payment. conflicting information there.

    Long and short of it, the question has been answered (Voluntary redundancy = 9 week disqualification)

    Not necessarily that could have a different meaning. It could mean that the company also made a voluntary payment to the staff being made redundant.

    Then it would be called an ex-gratia payment. There is a pretty solid definition between the two.

    mango salsa is correct. that could be the case and the deciding officer could have misinterpreted the term. if that's the case then write a letter and ask them to review the decision in light of this.
