Your first contact should be with the seller and see if it can be resolved in this way.

You are lucky that you paid with Paypal as this is in the buyers favour and if you do not have any luck with the seller directly you can raise a dispute with Paypal.

Was there anything mentioned in the listing that the seller can choose an alternative if the first choice is out of stock. In other non-ebay sites the seller should ask you if it is ok to ship the alternative.

You weren't necessarily scammed, you just got the wrong thing. If the seller refuses to replace them, or refund your money, that would be a scam.

First thing to do is contact the seller and tell him you didn't get what you ordered.

You paid for quality (Verbatim) and you received generic (Datawrite). There is no comparison from what I know, they don't even have the same dye.

I'd return them. Contact the seller first, they should also offer to pay return postage if you ask me. the next step would be a Paypal dispute.

While I agree, neither eBay nor Paypal will require the seller to do this. It's one of the biggest drawbacks with eBay. You also need to bare in mind that you should return them by registered post (more expensive) but if you don't, and the go missing, the seller doesn't have to do anything for you at all. The cost of returning a defective or wrong item on eBay can often make returning it largely pointless.
