Motoring fine car no longer mine

    I received a fixed penalty REMINDER in the post on Friday for not displaying a tax disc. I traded this car in a dealerships months ago and in fact know that the car has since been resold. I know it was resold because the dealership asked me for the tax book which I had lost. It is probable that the new registration hasn't been completed.

    There is an option to put in a Statement of nomination of name and address of the new owner but I don not have access to this information. I don't want to ignore this reminder for fear of being fined more or for the new owner to incur increased charges.

    Any advice would be most helpful...

    Afaik, the name of the Garda and station from where the penalty was issued, should be listed on the notice. Contact the station, find out when that Garda is on duty and then call down to the station in person and explain the situaion to that Garda. Bring whatever documentation you have - receipts etc.

    Seamus, the penalty, (not displaying a tax disc) was initiated by a warden I think, the reminder is from Galway County Council, it happened in Galway City, I live in Kildare.

    I think I will ring the dealership and see if they can help.

    Get a change of ownership form and bring it to the garage where you traded in. Get them to sign the form for the date you traded in the car. Bring the form to the prosecuting guard....case closed.
    Note that you are the gulity party until this is done.

    Afaik, County Councils or wardens cannot issue fixed penalty notices for non-display of tax. It's a legal charge and can only be made by a Garda. I could be wrong though.

    There must be some kind of contact number on the notice?

    Thanks Guys, I rang Galway CC and they said to bring it to the dealership, I wasn't really happy with that, what if they didn't bother to do anything with it. I went to my local Garda Station, he was able to tell me that the car was registered in a new name, since before the penalty notice date, the 1st of that month. He couldn't give me the detailed information, but I was happy enough to bring it to the dealership after hearing that. I feel I am off the hook, seeing that it is taxed in someone elses name from before the date of the fine. I kept a copy and will ring Galway CC again in a week or twos time to make sure all is well.

    There is certainly a grey area in this whole business, until a dealership sells on the car, it would appear to be in limbo. I guess the car is only re-registered when some one new buys it.

    Surely you got an invoice for the car you bought and that included the details of the car you traded in? If so then if it has the reg number you would be ok.

    Sometimes not... I have come across a few similar instances lately where there is no reference to the tradein on the invoice because the garage is selling the car on under the table. Most consumers wouldn't notice so long as the end product was only costing them the same amount. I have come across two examples similar to this in respect of toll fines being forwarded to people after they traded in.

    You simply have to lodge an appeal with the council if the ownership has now changed on the car. This appeal has to be in writing. Once they check the VRU and see the change of ownership the fine will be quashed.

    If the name on the tax book hasn't changed you need to fill in an affadavit form and the fine will be quashed upon completion of this.

    Councils are permitted to issue tickets for non display of a current tax disc.
